1. Agreement
These Terms govern your use of the Ball Up Top app and the balluptop.app website (together, the "Service"), operated by PB Ent. LLC ("we," "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.
3. Your account
You are responsible for activity under your account and for keeping your credentials secure. Provide accurate information and let us know promptly at hello@balluptop.app if you suspect unauthorized use. You may delete your account at any time in the app: Settings, Account, Delete Account.
4. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment. You may not copy, modify, reverse engineer, scrape, resell, or create derivative works from the Service or its content, except as permitted by law.
5. Archive Pass subscriptions
Today's daily games are free. Access to past daily games requires an active Archive Pass subscription.
- Archive Pass is offered as a monthly auto-renewing subscription.
- The current price is shown in the app before purchase confirmation.
- Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Manage or cancel your subscription in your Apple Account settings. Deleting the app or deleting your Ball Up Top account does not cancel a subscription.
- All purchases are processed by Apple and are subject to Apple's terms. Refunds are handled by Apple, not by us.
- If we change subscription pricing, we will give notice and the change will apply to subsequent billing periods.
6. Acceptable use
Do not use the Service to break the law; cheat, automate, or manipulate scores or leaderboards; harass other users; upload harmful code; probe or disrupt our systems; or misrepresent your identity. We may suspend or terminate accounts that violate these Terms.
7. Content and intellectual property
The Service, including its trivia content, game designs, software, branding, and the Ball Up Top name and logo, is owned by PB Ent. LLC and protected by intellectual property laws. Sports names, team names, and player names are the property of their respective owners and are used for identification and descriptive purposes only. We are not affiliated with, endorsed by, or sponsored by any league, team, or athlete.
8. Availability and changes
We may modify, suspend, or discontinue any part of the Service at any time. Game content is added and rotated regularly. We do not guarantee uninterrupted availability.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that trivia content is free of errors.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PB Ent. LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US$50. Some jurisdictions do not allow these limitations, so they may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless PB Ent. LLC from claims arising out of your misuse of the Service or violation of these Terms.
12. Apple
You acknowledge that these Terms are between you and PB Ent. LLC, not Apple. Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms and may enforce them against you. In the event of any failure of the app to conform to warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Los Angeles County, California, and you consent to that jurisdiction.
14. Changes to these Terms
We may update these Terms. We will update the "Last updated" date and, for material changes, provide notice in the app or by email.
