Terms of Use

These terms cover your use of the Ball Up Top app and balluptop.app (together, the "Service"), run by PB Ent. LLC ("we" or "us"). By using the Service, you agree to them. If you don't agree, please don't use it.

1. Who can play

You need to be at least 13. If you're under the legal age of adulthood where you live, a parent or guardian needs to be involved.

2. Your account

You're responsible for what happens on your account, so keep your login secure and your info accurate. If you think someone else is using your account, email hello@balluptop.app.

You can delete your account anytime in the app under Me → Settings → Delete Account.

3. Using Ball Up Top

You can use the Service for your own personal, non-commercial fun. We can revoke that permission.

You can't copy, modify, reverse engineer, scrape, resell, or build anything from the Service or its content, except where the law allows it.

4. Archive Pass

Today's games are free. Past games need an active Archive Pass.

• Archive Pass is a monthly subscription that renews automatically.
• You'll see the current price in the app before you buy.
• You're charged through your Apple Account when you confirm the purchase.
• It renews unless you turn off auto-renew at least 24 hours before the current period ends. Renewal is charged within the 24 hours before the period ends.
• Manage or cancel it in your Apple Account settings. Deleting the app or your Ball Up Top account doesn't cancel it.
• Apple processes all purchases under Apple's terms. Refunds are handled by Apple, not us.
• If the price changes, we'll let you know first. The new price applies from your next billing period.

5. Play fair

Don't:

• break the law;
• cheat, use bots, or mess with scores or leaderboards;
• harass other players;
• upload harmful code, or try to probe or disrupt our systems;
• pretend to be someone else.

Usernames and display names can't be hateful, sexual, threatening, or abusive. We have zero tolerance for that. You can report a player by emailing us, and we'll act on reports. That may mean removing the name or banning the account.

We can suspend or close accounts that break these terms.

6. What's ours

Ball Up Top's software, game designs, original trivia content, branding, and the Ball Up Top name and logo belong to PB Ent. LLC. Third-party data listed in Data credits below stays under its own license.

League, team, and player names belong to their owners. We use them only to identify who and what a question is about. We're not affiliated with, endorsed by, or sponsored by any league, team, or athlete.

7. Changes to the Service

We may change, pause, or shut down any part of the Service at any time. Games are added and rotated regularly, and we can't promise the Service will always be available.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We work hard on accuracy, but we can't guarantee every trivia answer is error-free.

9. Limits on our liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, PB ENT. LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$50.

Some places don't allow these limits, so they may not apply to you.

10. Indemnity

If your misuse of the Service or your breaking these terms leads to a claim against PB Ent. LLC, you agree to cover it.

11. Apple

These terms are between you and PB Ent. LLC, not Apple.

• Apple isn't responsible for the app or its content, and it has no obligation to provide maintenance or support.
• If the app doesn't conform to any applicable warranty, you can tell Apple, and Apple may refund the purchase price. To the extent the law allows, Apple has no other warranty obligation for the app.
• Apple isn't responsible for any claims about the app. That includes product liability, failing to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that the app infringes someone's intellectual property. We are responsible for handling those claims.
• You confirm you're not located in a country under a U.S. government embargo or listed as a terrorist-supporting country, and you're not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

12. Governing law

California law governs these terms, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts in Los Angeles County, California, and you agree to their jurisdiction.

13. Changes to these terms

If we update these terms, we'll change the date at the top. For big changes, we'll tell you in the app or by email first.
